Program Policies and Liability Waiver As a condition of registration in the BQYC Sail Training Program, the undersigned hereby understands, covenants, and agrees as follows: i. I will have a Ministry of Transportation approved personal floatation device (lifejacket) and shall abide by all safety rules and the rules of conduct and policies of Sailing Training which may be set from time to time by BQYC. ii. I may be photographed while taking part in Sailing Training activities and these photographs may be used for instructional or promotional purposes at the sole discretion of BQYC and that no further approval will be obtained and there will be no monetary compensation for such use. iii. The sport of sailing has risks and I will participate in the Sailing Training at my own risk. The Bay of Quinte Yacht Club, its directors, officers, members, employees, agents and instructional staff (the “BQYC”) shall not be held responsible in the event of accident or injury or for any damage to person or property. Furthermore, I shall save harmless and indemnify the BQYC from and against all claims, actions, cost, expenses and demands brought upon the BQYC in respect to death, injury, loss or damage to person or property howsoever caused, arising from or in connection with taking part in the Sailing School notwithstanding that the same may have been contributed to or caused by the negligence of BQYC. This release shall be binding on me, my heirs, executors and assignees. Concussion Code In recognition of the potential seriousness of a concussion, I understand and agree to follow the BQYC Concussion Code of Conduct and will follow the concussion related protocols and expectations as highlighted below: - Support a zero tolerance for behaviors that are associated for high risk of causing concussions - Be open, honest and forthcoming in regard to any situation I have been involved in, within sailing or outside of sailing, where a concussion has been suspected or confirmed - Be open, honest and forthcoming in regard to any signs and symptoms related to a concussion that I may be experiencing - Respect the roles and responsibilities of coaches in Removal from Sport Protocol - Should I be diagnosed with a concussion, in sailing or other activities, I agree to follow the Return to Sailing Protocol laid out by the BQYC Sailing School in conjunction with advice from my medical professionals I understand that failure to comply with any of the above may result in actions being pursued, such as, but not limited to: a) Termination of my participation in any given activity b) Removal of my right to participate in future related activities c) I may be subjected to further discipline by Ontario Sailing, Sail Canada and/or organization Mandatory Safety Requirements: - CCG or Transport Canada approved life jacket or PFD must be worn at all times when on or near the water. There will be no exceptions. - Sailors must wear clothing appropriate for weather conditions and have a change of clothing. - Footwear must be worn at all times. Sandals are not permitted while sailing or launching boats. - Waterproof sunscreen is required (SPF 15 or greater). - UV sunglasses and hats or visors are recommended. - Sailors must be able to swim 25 meters, wearing sailing clothing & equipment. - Wetsuits are permitted but not in lieu of PFDs. - All sailors must respect all BQYC rules.
